Terms of Use
These Terms govern your use of mysbtapp.com (the "Site"), operated by MySBT LLC ("MySBT," "we," "us"). By using the Site, you agree to them. If you don't agree, don't use the Site.
What these Terms cover
These Terms cover the Site only. Use of the MySBT application, including participation in the beta program, is governed by a separate written agreement between MySBT and your organization. Where that agreement and these Terms conflict as to the application, that agreement controls.
Eligibility
The Site is intended for professional and organizational use. You must be at least 18 and able to form a binding contract. If you're using the Site for an organization, you represent that you're authorized to act for it.
Permitted use
We grant you a limited, revocable, non-exclusive, non-transferable license to access the Site for your own informational and business purposes.
You agree not to:
- Use the Site unlawfully, or to infringe anyone's rights
- Attempt to gain unauthorized access to the Site, our systems, or any account
- Probe, scan, or test the vulnerability of our systems without written authorization
- Scrape or harvest content or data by automated means without our written consent
- Interfere with the Site's operation or impose unreasonable load on it
- Reverse engineer, decompile, or attempt to derive source code from the Site
- Misrepresent your identity or affiliation
- Submit anyone's confidential health, educational, or personal information through the Site's forms
Not clinical advice
MySBT builds tools that support clinical practice. Nothing on this Site is clinical, medical, behavioral, legal, or professional advice, and nothing on it establishes a professional relationship between you and MySBT.
Clinical decisions are yours. MySBT products are designed to assist licensed and certified practitioners exercising independent professional judgment within their scope of practice, supervision requirements, and applicable ethical codes. They do not replace that judgment, and they are not represented as diagnostic devices or as a substitute for appropriate clinical supervision.
Intellectual property
The Site and its contents — text, graphics, logos, and design — are owned by MySBT or its licensors and protected by intellectual property law. "MySBT" and the MySBT logo are marks of MySBT LLC. You may not use them without our written permission.
Third-party names and marks appearing on the Site, including those of FTF Behavioral Consulting, belong to their respective owners. Their appearance does not imply that those owners endorse any MySBT product except as expressly stated.
Feedback
If you send us ideas, suggestions, or feedback, you grant us an unrestricted, royalty-free, perpetual right to use them for any purpose without compensation or attribution. Don't send us anything you consider confidential or want to keep rights in.
Beta program
Information about the beta program on this Site is descriptive, not an offer. We select participants at our discretion and may decline, limit, or end participation at any time. Beta participation is governed by a separate agreement.
Third-party links
The Site links to sites we don't control. We're not responsible for their content, and a link isn't an endorsement.
Availability
We may modify, suspend, or discontinue the Site or any part of it at any time without notice. We don't guarantee uninterrupted or error-free availability.
Disclaimer of warranties
The Site is provided "as is" and "as available." To the fullest extent permitted by law, MySBT disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted, secure, accurate, or error-free.
Some jurisdictions don't allow certain warranty exclusions, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, MySBT and its members, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Site — even if we've been advised such damages are possible.
Our total aggregate liability arising out of or relating to the Site will not exceed one hundred US dollars ($100).
These limitations do not apply to liability that cannot be limited under applicable law. Some jurisdictions don't allow these limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless MySBT and its members, officers, employees, and agents from claims, damages, losses, and reasonable legal fees arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
Governing law
These Terms are governed by the laws of the State of Massachusetts, without regard to conflict of laws principles. Disputes will be brought exclusively in the state or federal courts located in Massachusetts, and you consent to their jurisdiction.
Changes
We may revise these Terms. Revisions take effect when posted, and the effective date above will change. Continued use after a revision means you accept it. Check back periodically.
Severability and entire agreement
If a provision is held unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and MySBT regarding the Site. Our failure to enforce a provision isn't a waiver of it.
